DMCA & Copyright Policy

Sidekick Intelligence LLC (DBA Chikoh) respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for responding to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512.
1. Designated Copyright Agent

2. Filing a DMCA Takedown Notice
If you believe that content on the Chikoh platform infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL or specific page where the content appears).
- Your contact information, including your name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or authorized to act on behalf of the copyright owner.
Important: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.
3. How We Process Takedown Notices
Upon receiving a valid DMCA takedown notice, we will:
- Promptly remove or disable access to the allegedly infringing material.
- Notify the user who posted or is associated with the removed content that the material has been removed or disabled.
- Provide the affected user with a copy of the takedown notice and information about how to file a counter-notification.
We aim to process valid takedown notices within 2 business days of receipt.
4. Filing a Counter-Notification
If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or the District of Wyoming if your address is outside the United States), and that you will accept service of process from the person who provided the original takedown notice or an agent of such person.
5. Counter-Notification Processing
Upon receiving a valid counter-notification, we will:
- Forward the counter-notification to the original complainant.
- Inform the original complainant that we will restore the removed material within 10–14 business days unless we receive notice that the complainant has filed a court action seeking to restrain the user from engaging in infringing activity.
- Restore the material within 10–14 business days after receiving the counter-notification, unless the original complainant notifies us of a filed court action.
6. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the platform or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.
Our repeat infringer policy works as follows:
- First offense: The infringing material is removed and the user receives a warning notification.
- Second offense: The infringing material is removed, the user receives a final warning, and the account may be temporarily suspended.
- Third offense: The user's account is terminated permanently.
7. Content on the Chikoh Platform
The Chikoh platform primarily displays statistical data, AI-generated analysis, and user-generated content within fantasy sports and entertainment contexts. We want to clarify the following:
- Statistical data: Sports statistics, player performance data, and game results are factual information and are generally not subject to copyright protection. However, the specific expression and presentation of statistical compilations may be protected.
- AI-generated content: Analysis, projections, and recommendations generated by our AI systems are original works created by Sidekick Intelligence LLC.
- User-generated content: Content posted by users (Syndicate/Squad discussions, trade proposals, league commentary) is the responsibility of the posting user.
- Third-party trademarks: Team names, league names, player names, and related marks are the property of their respective owners. Chikoh uses these marks for identification and informational purposes under nominative fair use.
8. Safe Harbor
Sidekick Intelligence LLC claims protection under the safe harbor provisions of the DMCA, 17 U.S.C. § 512. We are a service provider that hosts and transmits content at the direction of users. We do not monitor all user-posted content proactively but will respond promptly to valid takedown notices as described above.
9. International Copyright
While this policy is based on United States copyright law, we respect the intellectual property rights of copyright holders worldwide. If you are located outside the United States and believe your copyright has been infringed, please follow the takedown notice procedure described in Section 2, and we will handle your request in accordance with applicable law.
